Minutes for HB2783 - Committee on Federal and State Affairs

Short Title

Prohibiting a state agency, city or county from restricting the sale or use of motor vehicles based on the energy source used for the vehicles; allowing a state agency, city and county to have their own purchase policies for motor vehicles.

Chairperson Carpenter opened the hearing on HB2783.  The revisor provided an overview of the bill.

Chairperson Carpenter recognized Airika Brunson as a proponent of HB2783 (Attachment 12).  She stated that HB2783 preserves consumer choice in Kansas.  It allows those who want to purchase and drive an electric vehicle to do so, but it also allows those who prefer to drive gas or diesel powered cars to do that as well.  She urged the committee to support the bill.

The Chair recognized Brian Posler as a proponent on HB2783 (Attachment 13).  He stated that HB2783 is a pre-emption bill designed to prevent future government bureaucrats from regulating or restricting the sale of motor vehicles because of the vehicles' energy source.   The government should not be killing one industry to help another thrive when the free market might well produce the exact opposite outcome.

Dana Wreath testified as a proponent of HB2783 (Attachment 14).  He stated that the Kansas Independent Oil & Gas Association (KIOGA) supports this bill because it prevents over-regulation and allows drivers the freedom to choose the vehicle that best suits their needs.

Chairperson Carpenter recognized Colby Martin as a proponent of HB2783 (Attachment 15).  He stated that the Specialty Equipment Market Association (SEMA) supports HB2783 because it believes that consumer choice and innovation are the cornerstones of a thriving automotive industry.  This bill empowers consumers to make informed decisions about the vehicles they purchase and operate, which promotes a healthy and competitive marketplace.  It also fosters innovation across all fuel sources by creating a level playing field.  The Committee members had a number of questions.

Chairperson Carpenter noted that there is written proponent testimony from Randy Stookey, Renew Kansas Biofuels Association (Attachment 16); Glen Burdue (Attachment 17); Lynn Granger, American Petroleum Institute (Attachment 18); Kari Sue Vosburgh, We the People Kansas (Attachment 19); Brett Anderson (Attachment 20); Taylor Williamson, Kansas Corn Growers Association (Attachment 21); Becky Schwartz, Propane Marketers Association of Kansas (Attachment 22); and Michael Butler, Consumer Energy Alliance (Attachment 23).

Chairperson Carpenter recognized Spencer Duncan as an opponent to HB2783 (Attachment 24).  He stated that this bill is legislation for a non-existent problem that pushes aside constitutional home rule and the desire of Kansans to have local governments make these determinations.  The League of Kansas Municipalities and cities of Kansas respectfully ask the Committee to vote no on HB2783.

Chairperson Carpenter noted that there is written opponent testimony from Charlie Hunt, Johnson County Department of Health & Environment (Attachment 25).

Chairperson Carpenter closed the hearing on HB2783.

Chairperson Carpenter requested 24RS3011 on behalf of JumpStart, a bill creating the E-cigarette registry.  There being no objection, the request was accepted.
