Minutes for HB2263 - Committee on Transportation

Approving the operation and use of electric-assisted bicycles and regulating the use thereof.

The Revisor staff briefed the Committee on the contents of the bill and answered questions. (Attachment 1)

Chairman Proehl recognized Gary Robbins. (Attachment 2) Mr. Robbins said they were presenting this bill as part of a national effort to create uniform state laws on the use of electric bicycles.  He said 28 states have already approved this legislation with bills currently pending in 16 other states.

The next proponent was Alex Logemann.  (Attachment 3)  According to Mr. Logemann electric bicycles are a still emerging technology that need clear rules to regulate their use and create stability in the marketplace.  He said an electric bicycle is designed similarly to a traditional bicycle but has three additional components - a motor, a battery and electronics for riders  to control the system.

The first opponent was Amanda Stanley.  (Attachment 4)  She said while the League is not opposed to electric-assisted bicycles they do oppose the limits on local control proposed by this legislation.  She said as written the bill replaces what should be a legislative decision of a city's governing body.

The next opponent was Bill Maasen. (Attachment 5)   According to Mr. Maasen the Johnson County Park and Recreation District opposes this bill which allows Class 2 e-bikes to be operated on their system of paved trails.  He said they have studied the matter of e-bikes on multi-use trails and exercising their local control have chosen not to allow Class 2 e-bikes.

Written neutral (with concerns) testimony on HB2263 was received from the City of Shawnee, Kansas  (Attachment 6)  and the City of Overland Park, Kansas. (Attachment 7)

The Chairman asked if there were any other proponents, opponents or neutrals.  There were none so the Chairman closed the hearing on HB2263.
